Terms of Service
These draft terms describe expected account rules, acceptable use, subscription handling, intellectual property, confidentiality, and dispute provisions for Fair Access Shield. Open business and legal terms remain pending counsel review.
Acceptance and eligibility
By accessing or using Fair Access Shield, a user accepts these terms. Users must be at least 18, authorized to bind the buying organization, not on a sanctions list, and not a competitor evaluating the service for cloning or competitive misuse.
Account responsibility
Each account is for one human using their own Google account. Users may not share credentials and must promptly notify Fair Access Shield of suspected compromise, unauthorized access, or misuse.
Acceptable Use Policy
- Do not scan websites you do not own or do not have explicit written permission to scan.
- Do not use Fair Access Shield to discover vulnerabilities on unauthorized targets. Accessibility findings are not penetration-testing output, but the scan surface can overlap.
- Do not reverse engineer, scrape, overload, or misuse the platform.
- Do not resell scan output as a service without a written partner agreement.
- Do not use the service for illegal content, harassment, or scans of CSAM-adjacent surfaces.
Service description
Fair Access Shield provides accessibility scan workflows, Studio editor workspaces, verified reruns, and evidence exports. This product produces accessibility findings. It does not constitute legal advice and does not guarantee regulatory compliance with the ADA, Section 508, EN 301 549, or any other framework.
Subscriptions and billing
Subscriptions auto-renew until canceled. Customers may cancel through the Stripe billing portal when portal access is enabled. Annual plan proration, refunds, taxes, chargebacks, and failed-payment handling remain pending final business policy, counsel review, and applicable law.
Intellectual property
Fair Access Shield owns the platform, software, templates, marks, and service materials. Users retain ownership of their submitted content and scan output. Fair Access Shield may use de-identified aggregate usage data to improve the product.
Confidentiality
Scan data is treated as confidential. Fair Access Shield will not publish customer-identifying findings, screenshots, or evidence packages without permission except where required by law or necessary to operate and secure the service.
Warranty disclaimer and liability
The service is provided "AS IS" and "AS AVAILABLE" to the maximum extent permitted by law. Liability is capped at amounts paid in the trailing 12 months, with no liability for consequential, special, incidental, or punitive damages except for carve-outs required by law.
Indemnification
Each party should provide a narrow indemnity for its own intellectual-property infringement and Acceptable Use Policy breach, subject to process, notice, control, and cooperation requirements reviewed by counsel.
Termination
Either party may terminate under the notice period approved in the final Terms or customer agreement. Fair Access Shield may suspend or terminate immediately for an Acceptable Use Policy breach, unauthorized scanning, fraud, or security risk.
Governing law and disputes
Governing law, venue, arbitration, mediation, class-action waiver, jury-trial waiver, and small-claims carve-outs remain pending counsel review and business approval.
Changes and contact
Material changes should receive 30 days of notice. Continued use after the effective date means acceptance of the updated terms. Legal questions go to legal@fairaccessshield.com.
